1. Acceptance of these terms
By downloading, accessing or using Circle360 (the "App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility & accounts
You must be at least 18 years old to create an account. Children may participate only in a family circle set up and supervised by a parent or legal guardian, who is responsible for that child's use. You are responsible for the accuracy of your account details and for keeping your login credentials secure. You are responsible for all activity under your account.
3. The service
Circle360 lets members of a circle share location, receive arrival and safe-zone alerts, send a one-tap SOS, view community safety alerts, and use related safety features such as a vehicle plate watchlist and drive detection. Features may change, and we may add, modify or discontinue parts of the service.
4. Consent to location sharing
Location features work only when you choose to enable them. By enabling location sharing, you consent to Circle360 collecting and sharing your location with the members of your circle as described in the Privacy Policy. You may turn location sharing off at any time. Only share your location with people you trust, and only add people to a circle with their knowledge and consent.
5. Safety disclaimer — important
Circle360 is not an emergency response service and is not a substitute for emergency services, professional security, or your own judgement. SOS alerts, community safety alerts and location data depend on your device, connectivity, GPS accuracy, battery and third-party networks, and may be delayed, inaccurate or unavailable. In an emergency, always contact your local emergency services (such as 112 in Nigeria) directly. Do not rely on Circle360 as your sole means of safety.
6. Community alerts & user content
Community safety alerts, incident reports and other content are submitted by users, not by us. We do not verify and are not responsible for the accuracy of user-submitted content, and such content does not represent our views. You are solely responsible for content you submit, and you grant us a non-exclusive, worldwide, royalty-free licence to host, display and distribute it within the service for the purpose of operating Circle360.
7. Acceptable use
You agree not to:
- Track, stalk, harass or share the location of any person without their consent.
- Submit false, misleading, defamatory, or malicious alerts or reports.
- Use the vehicle plate watchlist to harass, profile or target individuals unlawfully.
- Violate any law, infringe others' rights, or misuse others' personal data.
- Attempt to disrupt, reverse-engineer, or gain unauthorised access to the service.
We may remove content and suspend or terminate accounts that violate these terms.
8. Subscriptions & payments
Circle360 is free to download. Some features may require a paid membership. Subscriptions are sold and billed through the Apple App Store or Google Play and are subject to those stores' terms. Payment is charged to your store account at confirmation of purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel your subscription in your App Store or Google Play account settings. Except where required by law or store policy, payments are non-refundable; refund requests are handled by the relevant app store.
9. Intellectual property
The App, including its software, design, logos and content (other than user content), is owned by Circle360 Technologies Ltd. and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the App for its intended purpose. You may not copy, modify, distribute or create derivative works except as permitted by law.
10. Third-party services
The App relies on third-party services (such as mapping, cloud and messaging providers) and may link to third-party content. We are not responsible for third-party services or content, which are governed by their own terms.
11. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, Circle360 Technologies Ltd. and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising from or relating to your use of (or inability to use) the App, including reliance on location data, SOS or community alerts.
13. Termination
You may stop using the App and delete your account at any time (see Account & Data Deletion). We may suspend or terminate your access if you breach these terms or if required to protect the service or other users.
14. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, and disputes will be subject to the exclusive jurisdiction of the Nigerian courts, without prejudice to any mandatory consumer protections available to you.
15. Apple App Store additional terms
If you download the App from the Apple App Store, the following also applies: these Terms are between you and Circle360 Technologies Ltd. only, not Apple; Apple has no obligation to provide maintenance or support for the App; Apple is not responsible for any product warranties or claims relating to the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government prohibited party list.
16. Changes to these terms
We may update these Terms from time to time. We will update the date above and, where appropriate, notify you in the App. Continued use after changes take effect means you accept the revised Terms.
